Terms of service
These terms govern purchases from Rack IT Systems LLC ("Rack IT") through rackit.com. Placing an order means you accept them. We sell to businesses and to individuals buying for business use.
Orders and acceptance
Your order is an offer to buy. A confirmation email acknowledges we received it; the contract forms when we ship. We may decline or cancel an order, in whole or in part, and refund you in full.
Prices and errors
Prices are in US dollars and can change without notice, because our own costs change daily. Despite our care, a listing may show the wrong price or specification. If the price we charged was clearly wrong, we'll contact you before shipping and you can confirm the corrected price or cancel for a full refund. We never charge more than the price shown without your agreement.
Availability
Stock figures come from our distributors and can move between the moment you order and the moment the warehouse picks it. If something sells out, we'll offer an equivalent product, a backorder with an estimated date, or a refund.
Payment
We accept major credit cards, Shop Pay, PayPal (including Venmo), Apple Pay and Google Pay at checkout. Approved trade accounts may buy on Net-30 terms; invoices unpaid after 30 days may carry a service charge of 1.5% per month, or the maximum the law allows, whichever is lower.
Sales tax
We collect sales tax where the law requires it. If you're buying for resale or you're a tax-exempt organization, send your certificate to billing@rackit.com before ordering and we'll set your account up as exempt. Certificates can't be applied to orders already placed.
Delivery, title and risk
Title and risk of loss pass to you when the carrier takes the shipment. Claims for damage in transit are handled under our refund policy.
Product information
Specifications, images and descriptions come from the manufacturers and from our own testing and research. Manufacturers change products without telling their resellers. Where a detail matters to your installation, ask us to confirm it against the current datasheet before you order.
Warranties
Products carry the manufacturer's warranty, and we'll help you use it. To the fullest extent the law allows, Rack IT makes no other warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Nothing here limits any right you have that cannot be limited by law.
Limitation of liability
To the fullest extent the law allows, Rack IT is not liable for indirect, incidental, special or consequential damages, including lost profits, lost data or downtime, arising from the sale or use of a product. Our total liability for any claim is limited to the amount you paid for the product the claim concerns.
Proper use
Electrical equipment must be installed by someone qualified and in line with the manufacturer's instructions and local code. You are responsible for choosing products suited to your application and for the installation itself.
Resale restrictions
Some manufacturers limit where and how their products may be resold. You agree not to export products in breach of US export law, and not to resell them into channels the manufacturer prohibits.
Governing law
These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any dispute belongs in the state or federal courts serving Vernon County, Missouri, and both of us consent to that venue.
Changes
We may update these terms. The version posted when you place an order is the one that governs it.
